Δ Delta 8 Products

Delta-8-THC products are not for use by or sale to persons under the age of 21.

Consume and use Delta-8-THC products responsibly. Consuming or using Delta-8-THC products may potentially result in a positive drug test for Delta-9-THC. 

(1) GHC believes that hemp-derived products containing naturally occurring Delta-8-THC and a 0.3% or less Delta-9-THC are legal under federal law as of the date of publication of these Disclaimers, which is July 31, 2020.  See H.R. 2: The Agricultural Improvement Act of 2018, also known as the 2018 Farm Bill; and

(2) GHC believes that hemp-derived products containing naturally occurring Delta-8-THC and 0.3% or less Delta-9-THC are legal under certain state laws as of the date of publication of these Disclaimers, which is July 24, 2020.  GHC makes no other guarantees, representations, and/or warranties that this Delta-8-THC product is legal in your state, territory, county or local jurisdiction. 

Legality and Regulation of THC and its related forms with respect to consumer goods

The historic 2018 Farm Bill amends the CSA and expressly removes “tetrahydrocannabinols in hemp” from the list of controlled substances. The 2018 Farm Bill included hemp-derived Delta-8 THC in the definition of hemp  as part of the hemp plant and it removed hemp-derived Delta-8 THC from the list of controlled substances as a tetrahydrocannabinol in hemp.  Tetrahydrocannabinol (THC) is the primary psychoactive component of the Cannabis plant. 

The DEA Rule now follows suit in that it modifies the listing of “tetrahydrocannabinols” on the Schedule of Controlled Substances by adding the following stipulation: *The 2018 Farm Bill expressly carved out “tetrahydrocannabinols in hemp” (See Section 12619(b) of the 2018 Farm Bill – indicates any type of THC from a cannabis plant with Delta-9 THC at or below 0.3% is legal (at the federal level).

Delta 8 THC is legal according to Georgia state law. Like federal law, Georgia specifically legalized all derivatives, cannabinoids, and isomers of hemp including all tetrahydrocannabinols other than delta 9 THC.
